This English version is a translation provided for your convenience. The French version is the only legally binding text and prevails in the event of any difference.

Vert Sapin is the trade name under which the company ONLY WAY SRL sells real Christmas trees and Christmas decorations on this online shop. This page brings together the information that a Belgian online shop must publish, in particular under Book XII of the Code of Economic Law, which governs the electronic economy. It tells you who publishes this site, who hosts it, what you may do with its content and which law applies.

The conditions of your purchase (price, delivery, payment, guarantee, withdrawal) are not set out here. They can be found in our general terms and conditions of sale.

2. Person responsible for publication

The person responsible for publication is Quentin De Buyst, in his capacity as manager of the company ONLY WAY SRL, who can be reached at the address of the registered office or by email at info@vertsapin.be.

Any question about the content of the site, any request for correction and any complaint may be sent to this address. Vert Sapin undertakes to reply to you in French.

3. Who hosts this site

The online shop is hosted by:

  • 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland

The host provides the technical platform. It does not write the texts, does not choose the photos and does not set the prices: these choices are the responsibility of the publisher, identified in section 1.

Online payments are processed by Shopify Payments and by PayPal. These providers act as payment services, not as hosts, and your bank details do not pass through our computers.

4. Intellectual property

The content of the site

The texts, the product descriptions, the layout, the visuals, the logo and the trade name Vert Sapin are protected by Book XI of the Code of Economic Law, which covers copyright and related rights. They belong to ONLY WAY SRL or are used with the consent of their holder.

Photographs

The photographs published on the site were taken in-house and are the property of ONLY WAY SRL. They may not be reused without our prior written consent.

What you may do, and what you may not do

  • You may consult the site, print it and save pages for your private use.
  • You may share a link to a page of the site.
  • You may not copy, republish, translate, modify or commercially exploit all or part of the content without our prior written consent.
  • You may not extract the product photos to use them on another online shop.

A request for permission is made by email to info@vertsapin.be. It is examined on a case-by-case basis.

5. Links to other sites

The site may link to pages that we do not manage, for example a social network, an online map or a payment service. These links are there for your convenience. We have no control over these sites, their content or the way they process your data. Their use is subject to their own terms and their own privacy policy.

If a link is broken or leads to content that seems problematic to you, report it to info@vertsapin.be. We will correct it.

6. Limitation of liability

We write and check this site with care. An error nevertheless remains possible: a typing error, a photo that no longer corresponds exactly to the product delivered, information that has become outdated between two seasons. We correct these errors as soon as we become aware of them. This correction does not take away any of your rights: if the product delivered does not match what you ordered, you retain the legal guarantee of conformity and the remedies provided for by law.

We do not guarantee that the site will be accessible without interruption. Maintenance, a failure at the host or a network incident may make it temporarily unavailable.

Two important limits to the above:

  • This page in no way reduces the commitments made to you when you place an order: tree delivered netted at your door, to the address given and in the time slot you choose, and free delivery in Brussels and the surrounding area, that is, in the 19 municipalities of the Brussels-Capital Region and the 18 municipalities bordering it. Elsewhere in Belgium, delivery costs €9.90 VAT included per order, whatever items are ordered. There is no minimum order. The amount of the delivery charge applicable to your address is displayed before the order is confirmed. Setting up and decorating the tree fall under our home service, which is subject to a separate quote and is not part of an order placed on the online shop. These commitments fall under our general terms and conditions of sale and remain due.
  • This page excludes neither our liability in the event of fraud or gross negligence, nor our liability in the event of non-performance of one of our main obligations, nor the rights that Belgian law grants to consumers, in particular the two-year legal guarantee of conformity provided for by articles 1649bis et seq. of the former Civil Code.

7. Personal data and cookies

ONLY WAY SRL is the controller of your personal data within the meaning of the General Data Protection Regulation. How we collect it, what we do with it, how long we keep it and how you exercise your rights are described in our privacy policy, available on the site, section 7 of which deals with cookies. 8. Complaints

If there is a problem, contact us first: most situations are resolved by an email or a call. If no solution is found, a consumer can turn to the Consumer Mediation Service, the Belgian public entity responsible for the out-of-court settlement of consumer disputes. 9. Applicable law and competent courts

This site and the relationships it creates are governed by Belgian law.

We do not impose any court on you in advance. In the event of a dispute, the competent court is the one designated by the statutory rules, in particular articles 624 et seq. of the Judicial Code.

If you reside in another country of the European Union, you retain the right to bring proceedings before the court of your place of residence, and we can only bring proceedings against you before that court. The choice of Belgian law also does not deprive you of the protection afforded to you by the mandatory rules of the country in which you habitually reside.

10. Changes to this page

This legal notice may be adapted, for example if our contact details or our host change. The applicable version is the one published on the site at the time you consult it.
