Terms of service
Welcome to Vert Sapin. The following lines explain, in plain language, what you commit to when you order a tree or a decoration on our site, and what we commit to towards you. We invite you to read them before confirming your order.

1. Purpose and scope
These general terms and conditions of sale apply to any order placed at a distance on the site https://vertsapin.be. Together with the order confirmation we send you and with the information we give you on the site before your order, in particular the product description and the delivery conditions, which form an integral part of the contract, they make up the contract.
By confirming your order, you declare that you have read these terms and that you accept them. They take precedence over any other terms, unless we have agreed otherwise in writing.
These terms are written for the consumer, that is, the natural person who buys for their private use, outside any professional activity. If you order for the needs of a business, an association or a joint professional ownership, the rules specific to consumers, in particular the right of withdrawal described in section 9 and the legal guarantee of conformity described in section 10, do not apply to you.
Purchases made directly at our stalls, in the presence of our sellers, are not distance sales. They therefore do not give rise to the right of withdrawal provided for in section 9. Be careful not to confuse the two: an order placed online and then collected at a stall remains a distance sale. The contract was formed on the site, not at the stall. You therefore retain all the rights described below, the withdrawal period expiring fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.

The online shop is hosted by Shopify International Limited, 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland.
3. Our products
We sell real Christmas trees, Nordmann fir and Norway spruce, as well as Christmas decorations: shatterproof baubles, garlands, fairy lights, tree toppers, mugs, stockings, snow sprays, bauble hooks and wooden cross stands.
A tree is a natural product. Two trees of the same size are never identical: the density of the branches, the shape and the shade vary from one tree to another. The photos on the site are for illustration only and are not contractually binding on these points. The stated size is an approximate size, measured according to the practices of the trade.
Our products are sold while stocks last. Trees are delivered during the season: the first delivery takes place on 20 November and the last on 24 December, every year. The online shop, however, does not close: it remains open all year round. Outside the season, trees can still be ordered, but they are only delivered from 20 November; Christmas decorations, for their part, can be ordered and delivered all year round. If a product ordered became unavailable, we would inform you without delay and refund you in full the sums already paid for that product.
4. How your order is formed
The order takes place in four steps.
- You choose your products and add them to the basket.
- You enter your delivery address and the date on which you wish to receive your delivery.
- You check the summary, which sets out the details of the products and the total amount to be paid, and you correct it if necessary.
- You confirm by clicking on the “Order with obligation to pay” button, then you pay.
The contract is concluded as soon as your payment has been validated. We then send you, without delay, an order confirmation by email setting out the essential elements of your purchase. Keep it: it will be useful to you if you have any questions.
As the last delivery of the season takes place on 24 December and at least twenty-four hours must be allowed between your order and our team's visit, an order to be delivered before Christmas must reach us no later than 23 December.
We reserve the right to refuse or cancel an order on legitimate grounds, for example an obvious pricing error, a delivery address that is incomplete or located outside Belgium, a failure to pay, or an unresolved earlier dispute. In that case, you are refunded at no cost.
The contract is concluded in French. We archive orders in our systems and you can ask us for a copy at info@vertsapin.be.
5. Prices
All prices displayed on the site are expressed in euros and are inclusive of all taxes, Belgian VAT included. The price you read on the product page is the price you pay: no tax or surcharge is added at the time of payment, other than any delivery charge described below.
Delivery is free in Brussels and the surrounding area, that is, in the 19 municipalities of the Brussels-Capital Region and the 18 municipalities bordering it. Elsewhere in Belgium, it costs €9.90 VAT included per order, whatever items are ordered. There is no minimum order. The amount of the delivery charge applicable to your address is displayed before the order is confirmed. For a tree, delivery includes netting and leaving it at your door. The wooden cross stand is not included: it is an accessory sold separately. There are no hidden charges.
The applicable price is the one displayed at the moment you confirm your order. A later change in our prices has no effect on an order that has already been confirmed.
Two VAT rates apply to our products: 6% on trees and 21% on decorations and other items. These rates are already included in the prices displayed on the site.
6. Payment
Payment is made online, at the time of the order, through Shopify Payments or PayPal. Your card details are processed directly by the payment provider, on its own secure servers. We never have access to them and we do not keep them.
The products remain our property until the price has been paid in full. This has no bearing on the transfer of risk described in section 8.
7. Delivery and pick-up
Delivery
We deliver throughout Belgium, 7 days a week, from 9:00 to 21:00, in 3-hour time slots, for any order that includes a tree; an order for decorations only does not require an appointment and is sent out as soon as possible. For a tree, you choose the day and the time slot of the delivery when you order, allowing at least twenty-four hours between your order and our team's visit: this agreed date serves as the delivery period. The tree is delivered netted, at your door, at the address you have given and in the time slot you have chosen.
Our team leaves the tree at your door: that is where our commitment ends. The team often carries it upstairs, when this is possible, but this is not guaranteed. It does not put it in place and does not set it up. Setting up and decorating fall under our home service, which is subject to a separate quote and is not part of an order placed on the online shop.
You can move or cancel your delivery appointment up to twenty-four hours before the agreed time, by writing to us at info@vertsapin.be or by calling +32 479 73 03 49.
We ask that an adult be present at the address given at the agreed time, and that access to the place of delivery be practicable. If no one is present, we get back in touch with you to arrange a redelivery, free of charge.
If we do not deliver on the agreed date, you can set us, in writing, a reasonable additional period. If that period passes without delivery, you can cancel the order and be refunded all the sums paid. You can also cancel immediately, without granting us an additional period, if we refuse to deliver or if the agreed date was essential for you, which is the case for a delivery scheduled before Christmas. The refund is then made without delay.
Pick-up in January
Our pick-up service after the holidays exists only as part of our services on quote, for businesses and for private customers (home service), for which it is included in the quote.
It does not apply to orders placed on the online shop: we do not come back to pick up the tree or the decorations bought on the site.
8. Transfer of risk
The risk of loss of or damage to the tree and the decorations passes to you at the moment you acquire physical possession of the products, or when a third party indicated by you acquires possession of them. Until then, the risk of transport lies with us.
We invite you to check the condition of the products on delivery, in the presence of our team. Visible damage reported straight away is settled much more simply.
If you notice visible damage on delivery, you have one week to confirm it to us in writing at info@vertsapin.be. This period is a practical convenience and does not take away any of your legal rights: the two-year legal guarantee of conformity described in section 10 remains intact, and you can report a defect to us within two months of the day on which you notice it.
9. Right of withdrawal
For a purchase made at a distance on our site, the law gives you a right of withdrawal: you can withdraw from your purchase without having to give a reason and without penalty. This right derives from Book VI of the Code of Economic Law. It does not apply to purchases made directly at our stalls.
Christmas decorations
For Christmas decorations, you can withdraw from your purchase, without having to give a reason and without penalty, within a period which expires fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.
The real tree
The real tree is excluded from the right of withdrawal. It is a cut tree, that is, goods liable to deteriorate rapidly, for which the law expressly excludes this right. You are informed of this here, before your order.
In return, if the delivered tree does not suit you, it can be exchanged on the spot, at the time of delivery, depending on the trees available in the van, including for a different size. If nothing suits you, we look for a solution with you: a redelivery or a refund.
Returning the products and the refund
If you withdraw, you send the decorations back to us at the following address: ONLY WAY SRL, Rue du Pinson 64, 1170 Watermael-Boitsfort. The cost of this return is borne by us: the law would allow us to leave it to you; we have chosen to bear it. Returning items in person at one of our stalls, however, is not possible.
Where the withdrawal is accepted, we refund you within fourteen days of becoming aware of your decision, using the same means of payment as the one used for the order. If you withdraw from your entire order, the delivery charge you paid is also refunded to you. If you keep a tree and send back only decorations, it is not: it also covers the tree you are keeping.
How to exercise your right
To exercise your right of withdrawal, simply write to us at info@vertsapin.be stating your order number and the products concerned. You can also use the model withdrawal form below, without being obliged to do so.

10. Legal guarantee of conformity
You benefit from the legal guarantee of conformity of two years provided for by Belgian law for sales to consumers (articles 1649bis et seq. of the former Civil Code). This guarantee is free of charge and is in addition to your other rights.
In practical terms, the product delivered must match what you ordered: the right species, the right stated size, a sound condition. If this is not the case, you are entitled to repair or replacement and, if this is not possible or appropriate, to a price reduction or to termination of the sale with a refund.
A real tree remains a cut plant. The gradual loss of needles, drying out or a change of shade over the weeks are part of the normal development of the product and not a lack of conformity, especially if the tree is placed near a source of heat or is not watered. Likewise, damage caused by abnormal use, a fall, an animal or a modification of the product is not covered.
We ask you to report any defect to us at info@vertsapin.be, with your order number and, if possible, a photo, within two months of the day on which you notice the problem: this two-month period is the minimum provided for by law.
11. Our liability
We are liable for the proper performance of the contract: delivering the product ordered at your door, to the address given and on the agreed date.
We are not liable for damage resulting from inappropriate use of the tree or the decorations, in particular failure to follow the safety instructions for fairy lights, proximity to a flame or a heating appliance, or the way in which the tree is moved and put in place after delivery.
No clause of these terms limits our liability in the event of fraud, gross negligence, breach of an essential obligation of the contract, or in the event of personal injury. These cases remain fully covered by the general law.
12. Force majeure
We cannot be held liable for a delay or a failure to perform caused by an event beyond our control, which could not reasonably have been foreseen or avoided.
This includes in particular extreme weather conditions, impassable roads, a fire, a general strike or a strike outside our company, a decision by the authorities or a major network failure. The failure of a carrier or a supplier we use is not a case of force majeure: we are answerable to you for it.
We inform you as soon as possible and we look for a new date with you. If the impediment continues and makes the delivery pointless for you, in particular after the holidays, either party may terminate the contract and you are refunded the sums paid.
13. Protection of your data
We process your personal data in order to carry out your order, deliver to you and answer your questions. We do not sell it.

If a reply does not satisfy you, you have the right to lodge a complaint with the Data Protection Authority, the competent Belgian authority for personal data. 14. Complaints and dispute resolution
If there is a problem, first write to us at info@vertsapin.be or call +32 479 73 03 49. We reply to emails in French within twenty-four hours and our telephone line is open every day from 10:00 to 19:00. Most situations are resolved in a single exchange.
If we cannot find a solution, you can turn free of charge to the Consumer Mediation Service, the Belgian public body responsible for consumer disputes.

The European Commission had set up a European online dispute resolution platform (ODR platform) for online purchases. This platform ceased operating on 20 July 2025. For a purchase made on our site, the preferred route is therefore the Consumer Mediation Service mentioned above.
Recourse to mediation is optional and does not deprive you of any of your rights.
15. Applicable law and competent courts
These terms and the contracts arising from them are governed by Belgian law.
In the event of a dispute that cannot be settled amicably, you can bring the matter before either the court of your place of residence or the court of our registered office. For our part, we can only bring proceedings against you before the court of your place of residence. You continue to benefit from the mandatory provisions of the law of the country in which you reside.
16. Miscellaneous provisions
If a clause of these terms were held to be void or unenforceable, the other clauses would remain fully in force.
We may amend these general terms and conditions of sale at any time. The version applicable to your order is the one online at the moment you confirm it.
Failure to invoke a clause immediately does not constitute a waiver of the right to rely on it later.
