Shipping policy
This page explains how we deliver the Christmas trees and decorations ordered on vertsapin.be. It forms part of our general terms and conditions of sale. Vert Sapin is the trade name of ONLY WAY SRL.
Delivery area
We deliver throughout Belgium. No municipality is excluded. The delivery charge, however, depends on the address: it is explained below.
We do not deliver outside Belgium.
Delivery charges
Delivery is free in Brussels and the surrounding area, that is, in the 19 municipalities of the Brussels-Capital Region and the 18 municipalities bordering it. Elsewhere in Belgium, it costs €9.90 VAT included per order, whatever items are ordered. A tree on its own, decorations on their own, both together: the same rule applies in every case.
There is no minimum order. The amount of the delivery charge applicable to your address is displayed before the order is confirmed.
The price displayed on the product page is a price inclusive of all taxes, Belgian VAT included: 6% on trees, 21% on decorations and other items. It is the price you pay; only the delivery charge is added to it, if it applies to your address. Nothing else is added at the time of payment.
No amount that does not appear in your order will be claimed from you afterwards.
What you receive
Each tree is delivered:
- netted, which protects the branches during transport;
- without a wooden cross stand: this is an accessory sold separately;
- together with the decorations you have ordered, if any.
You remove the net yourself, once you have stood the tree up in the place of your choice.
Time between your order and delivery
The online shop remains open all year round. Trees, however, are delivered during the Christmas season: the first delivery of the season takes place on 20 November and the last on 24 December. These dates apply every year. Outside this period, trees can still be ordered: the date you choose in the basket is then the first available date of the following season. Christmas decorations, for their part, can be ordered and delivered all year round.
You choose your delivery date yourself when you order, from the dates still available.
Allow at least 24 hours between your order and delivery: this is the time we need to prepare your tree and load the van. The first time slot you can choose is therefore 24 hours after your order.
Together, these two rules give the deadline for delivery before Christmas: the last delivery of the season takes place on 24 December and 24 hours must be allowed: your order must therefore be placed no later than 23 December.
Choosing the day and the time
You indicate the day and the time slot that suit you during the order. We come to the address you have given, within that time slot.
We deliver 7 days a week, from 9:00 to 21:00, in 3-hour time slots. The timing is yours: weekend, public holiday, during the day or in the evening, you choose the one that suits you.
Check your address, your box number, your floor and your telephone number carefully. We use this number to let you know before we arrive.
An appointment already made can be moved or cancelled up to 24 hours before the planned time slot, by email to info@vertsapin.be or by telephone on +32 479 73 03 49.
On the day of delivery
Delivery is carried out by the Vert Sapin team itself. We bring the tree to your door, at the address you have given and within the time slot you have chosen. Our commitment ends there. The team often carries the tree upstairs, when this is possible, but this is not guaranteed; it does not put it in place.
Setting up and decorating the tree fall under our home service. This is subject to a separate quote and is not part of an order placed on the online shop. For a home service by quote, write to us at info@vertsapin.be.
The tree and the decorations are handed over in person: make sure you are present during the chosen time slot, or that someone receives the order for you.
If no one is present
If no one is present to receive the order, we get back in touch with you to arrange a redelivery, free of charge.
Checking on receipt and damage
Take the time to look at the tree and the decorations when they are handed over, while the team is still there.
If you notice a breakage, damage or a mistake in the order, report it immediately to the team present. You can refuse an item that is visibly damaged. Then confirm by email to info@vertsapin.be, with photos and your order number, within the week following delivery.
This one-week period does not take away any of your legal rights: it serves only to settle quickly any damage visible on the day of handover.
The legal guarantee of conformity covers any defect that already existed at the time of delivery, whether or not it was visible on the day of handover. Not having noticed it on delivery does not cause you to lose any right. This guarantee lasts two years from delivery.
We ask you to report a defect to us by email to info@vertsapin.be within two months of the day on which you notice it: this is the minimum period the law guarantees you. The check on receipt described above serves to settle things more quickly. It is not a condition of the legal guarantee.
A real tree is a living product. Its silhouette, the density of its branches and the shade of its needles vary from one tree to another. These normal variations are not defects.
The following, on the other hand, are defects, covered by the legal guarantee: a tree that is dry or that sheds its needles en masse from delivery, a broken or split trunk, a height clearly lower than the one stated, a species other than the one you ordered, a wooden cross stand ordered and missing on delivery.
The details of the legal guarantee are set out in our general terms and conditions of sale.
Transfer of risk
Until delivery, the risks of loss and damage lie with us, transport included. They pass to you at the moment the tree and the decorations are handed over in person to you or to the person you have designated at the delivery address.
In other words: if an item breaks on the way, that is our concern. If it breaks after we have handed it over to you, it is yours.
Late delivery
The date you have chosen is binding on us. If something unforeseen prevents us from keeping to it, we let you know and offer you a new date as soon as possible.
You can grant us a reasonable additional period. If we do not deliver within that period, you terminate the order and we refund you all the sums paid, without delay.
You are not obliged to grant us this additional period in three situations: if we refuse to deliver; if the agreed date was essential in view of the circumstances, which is the case for a tree ordered for Christmas; if you had informed us before the order that a specific date was essential for you. In these three cases, you terminate the order immediately, and we refund you all the sums paid, without delay.
An event beyond our control (extreme weather conditions, a closed road, an accident) may delay a visit. In that case we contact you to arrange a new date.
If the new date does not suit you, or if it falls after the celebration for which you had ordered, you can cancel the order. We then refund you all the sums paid, without delay.
Cancelling your order
Late delivery is not the only case of cancellation. For an online purchase, the law in principle allows you to change your mind, without having to give a reason, within a period which expires fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods. The conditions and exceptions are set out in our withdrawal and returns policy.
Two regimes coexist with us, because we sell two different things. A cut real tree is a perishable product: it is excluded from the right of withdrawal. In return, if you do not like the delivered tree, we exchange it for you on the spot, depending on the stock available in the van, including for a different size. If nothing suits you, we look for a solution with you: a redelivery or a refund. Decorations and accessories, for their part, keep this right: the period expires fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.
When you send decorations back, the cost of return is borne by us: the law in principle places it on the customer; we have chosen to bear it ourselves. Items are returned by post to ONLY WAY SRL, Rue du Pinson 64, 1170 Watermael-Boitsfort. We do not take items back in person.
Pick-up of the tree in January
The pick-up of the tree after the holidays exists only as part of our services on quote, for businesses and for private customers (home service), where it is included in the quote. It is not part of orders placed on the online shop.
If you order here, we therefore do not come back to pick up the tree or the decorations in January: the tree remains your responsibility after the holidays. For a home service by quote with pick-up included, write to us at info@vertsapin.be.
Collecting your order at a stall
You can also order online and come and collect your order yourself at one of our stalls in Brussels, rather than having it delivered. This collection is free.
You choose collection when you order. We confirm the stall and the time at which your order will be ready there. Here too, allow at least twenty-four hours between your order and collection.
The addresses and opening hours of the stalls change from one season to the next. They are announced on the site during the season, and we confirm them to you with your order.
Bring your order number with you. You can load your tree yourself, or ask us for a hand on the spot.
Collecting from a stall changes nothing about your rights. Your order was placed online: it is a distance sale, and the right of withdrawal applies exactly as if you had had it delivered. For decorations, the period expires fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods: at the stall, that is the day on which you collect your order. The real tree remains excluded, for the same reason as elsewhere: it is perishable goods.
It is different for a purchase made directly at a stall, without a prior order: that purchase is not a distance sale and does not give rise to a right of withdrawal.
The risks pass to you at the moment you take your order in hand at the stall. Check your tree on the spot, as you would on delivery: it is the best time to report anything at all.
Orders of decorations without a tree
An order that contains no tree is delivered throughout Belgium, all year round, at the same delivery rates as the others: free delivery in Brussels and the surrounding area and €9.90 VAT included per order elsewhere in Belgium, with no minimum order. It does not require an appointment: we send it out as soon as possible. Trees are delivered by our team; for a parcel of decorations, we may use a postal service provider. In both cases, the delivery charges are the same.
